Dear President:
I am writing to you out of concern for Mirel Ciprian Cucu and Milorad Mutascu, who have been arrested and charged solely for their homosexuality. They were arrested on 22 January 1993 under Article 200 of the Romanian Penal Code, which allows for a possible prison sentence of up to five years for having sexual relations with a person of the same sex. These men are in a consensual and private relationship. They present no danger to society.
I request that you do everything in your power to see that the charges against them are dropped and that Mr. Mutascu is released from prison. Please see that Mr. Mutascu is not ill-treated while he is held in custody.
I believe that both these men would be prisoners of conscience if they were convicted and sentenced solely because of their consensual relations in private. I urge you to abolish Article 200, which only punishes prisoners of conscience. Thank you for your attention to my requests. I would very much appreciate a reply.
